Trust disputes can also arise where a fiduciary duty has been breached, for example where a solicitor trustee has stolen money, or a company director took funds. We also frequently see cases involving ‘constructive’ trustees, who are defined in law as holding property for someone else. For example, a parent gives their son £150,000 from the company as a wedding gift, in breach of the trust. The son may not have known the source of the funds but could still face a claim on the basis of being a constructive trustee.
